Fundamentals
All deliveries and services of Alpenhigh based on online orders via the Internet are subject to these terms and conditions. Any deviating and/or supplementary agreements shall require the express consent of Alpenhigh and the written form; this shall also apply to any waiver of the written form requirement. No fundamental waiver of the validity of the following provisions can be derived from a tacit waiver of the written form requirement in the past and in the future. Terms and conditions of the buyer, customer or contractual partner that deviate from the following provisions are not binding, even if they have not been expressly contradicted. Supply and service contracts shall only become binding after confirmation by us. Obvious inaccuracies, typing or calculation errors entitle us to make corrections at any time without loss of legal validity. If the contractual partner defaults on its counter-performance or cooperation obligations, we shall be entitled to suspend the further execution of contracts until the contractual partner has fulfilled its obligations without being released from its obligations. The contractual partner is also obliged to compensate us for any damage caused by the delay. In the event of default on the part of the contractual partner, we shall also be entitled to withdraw from the contract as a whole and to demand compensation for non-performance. Damages for non-performance shall be set at 30% of the contract amount as agreed, unless we have incurred higher damages. Offers are subject to change until confirmed by us in writing. If orders are canceled - for whatever reason - we have the right to charge the costs incurred up to that point on a time and material basis.

All PRICES are in EURO. We expressly reserve the right to make printing errors.

The goods are ordered by sending the order form. After submitting the form, you will receive a confirmation and invoice for the registered order.
Payment options
The goods are paid for:
Hemp cuttings: Cash, by bank transfer, or payment to our bank account by payment slip, by prepayment, RIA
Payment house: Cash, by bank transfer, or payment to our bank account by payment slip, by prepayment, Joker Mastercard (please write us an email and ask for Joker Mastercard...), Bitcoins, RIA, ApplePay, GooglePay or credit card (Mastercard / Visa). Other payment methods require a written agreement.
As soon as the amount has been credited to the account, the order will be dispatched. We have no influence on the delivery time. We ship every Monday and every Wednesday - excluding public holidays, of course!
Additional order costs
Postage, packaging and delivery costs as well as customs and transfer charges shall be borne by the customer. We reserve the right to make partial deliveries. Transport damage and insurance depend on the parcel service and Alpenhigh accepts no liability for this.
Alpenhigh has no influence on delivery times. Any risk of deterioration or loss of the goods is transferred to the customer when the goods are handed over to the transport company. The exact delivery costs are displayed during the ordering process.
Orders exceeding the amount of EUR 150,- (€) are free of shipping costs. For returns and unaccepted orders, 10% of the final invoice amount will be charged as administration costs.
Retention of title
Our deliveries and services are provided exclusively subject to retention of title. Ownership shall not pass to the customer until all obligations to us have been fulfilled in full. This shall also apply if the purchase price for individual deliveries of goods designated by the customer has already been paid. In the case of current accounts, the retention of title shall serve as security for our balance claim and shall relate to all deliveries made to date.
Transportation and warranty for defects
The transportation risk lies with the customer. Complaints must be made in writing within 7 days of receipt of the delivery. The customer must check the condition of the delivered goods immediately after delivery.
Liability
We assume no product liability and are not liable for consequential damage. We only sell products from reputable manufacturers and, unless otherwise stated, deliver the goods in their original packaging. If customs (or another authority) does not allow the order to be imported into the country of destination, the customer has no right to compensation!
Purpose of the plants
The hemp plants sold by us are used exclusively for botanical, decorative or ornamental purposes. The buyer undertakes not to use the plants for the production of narcotics or in any other illegal manner.Flowering and fruiting
The plants must not flower or produce fruit in order to comply with the applicable legal provisions. The buyer is responsible for keeping the plants in such a way that no flowers develop.Legal responsibility
The buyer bears full responsibility for compliance with the legal regulations of the respective country regarding hemp plants. The seller assumes no liability for the improper or illegal use of the plants.Plant protection regulations
When shipping plants to other countries, the plant protection regulations of the EU apply. The plants are only shipped healthy and free of pests or diseases. The buyer confirms that he will only accept the plants in accordance with the applicable phytosanitary regulations.Disclaimer
The seller assumes no liability for violations of national or international laws by the buyer in connection with the possession or use of the plants.
Age limit
We do not sell goods to persons under the age of 18.
Effectiveness
The invalidity of individual provisions of these General Terms and Conditions shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a provision that comes as close as possible to the economic effect of the invalid provision.
Place of fulfillment
The place of jurisdiction and place of performance for the services owed by both parties under the order shall be the registered office of Alpenhigh. This is Los Cristianos, Santa Cruz de Tenerife, Spain for the auction house and Graz, Austria for the hemp cuttings. Austrian/Spanish law applies to all transactions with Alpenhigh. The application of the UN Convention on Contracts for the International Sale of Goods is excluded.
Right of withdrawal
Consumers (§ 13 ABGB) have a statutory right of withdrawal. You can revoke your contractual declaration within two weeks without giving reasons in text form (e.g. letter, contact form) or by returning the goods. If damaged or worn goods are returned, the legally permissible amount will be deducted; you can avoid this by simply inspecting the goods as you would have been able to do in a store, for example, and returning them without signs of use and in their original packaging.
Warranty
The warranty is provided in accordance with the statutory provisions, whereby in the event of a defect in the goods we will, at your discretion, first deliver or repair the goods. If the rectification fails or if the subsequently delivered goods are also defective, you can return the goods for a refund of the full purchase price or keep the goods and reduce the purchase price.
Please refer to the product documentation for information on any manufacturer's guarantees, but as a general rule, no guarantee is given for hemp seeds as they are living material.

Place of jurisdiction
